Terms & Conditions

These terms and conditions (“Terms and Conditions”) apply to Juice by Jewson (the “Rewards Programme”), a Rewards Programme for trade customers of Jewson Limited trading as Jewson (company number 00348407) whose registered office is at Saint-Gobain House, Coventry CV3 2TT (“Jewson”) who have an Account (as defined below). Please read these Terms and Conditions carefully and make sure that you understand them before registering for the Rewards Programme. By completing the online registration form for the Rewards Programme at www.juicerewards.co.uk (“Website”), and by participating in the Rewards Programme, the Participant (as defined below) and any representative of the Participant (“Representative”), agree to be bound by these Terms and Conditions and the Terms of Use, Privacy Policy, Acceptable Use Policy and Cookie Policy applicable to the Website.

1

The Rewards Programme

 

1.1

The Rewards Programme may be operated on behalf of Jewson by certain third party suppliers engaged by Jewson for that purpose.

 

1.2

The Rewards Programme shall continue until terminated by Jewson in accordance with clause 8.

 

1.3

The Rewards Programme is only open to:

 

 

1.3.1

Jewson Trade Account and Jewson Trade Cash Card Account (the “Jewson Accounts”) holders; and

 

 

1.3.2

Trade Account holders of other brands of Jewson Limited or Saint-Gobain Building Distribution Limited (“SGBD”) who are invited by Jewson to register for the Rewards Programme (the “SGBD Accounts”),

 

 

 

(the “Participant(s)” and each a “Participant”). The Jewson Accounts and the SGBD Accounts shall together be referred to as the “Accounts”, each may be referred to as an “Account.

 

1.4

Unless Jewson expressly agrees otherwise in writing, the definition of Participant excludes:

 

 

1.4.1

(subject to clause 1.3.2) any and all other holders of trade accounts (being cash or credit) of other brands of Jewson Limited or Saint-Gobain Building Distribution Limited;

 

 

1.4.2

any and all holders of Accounts who are public sector organisations or housing associations;

 

 

1.4.3

any and all current and previous employees of Jewson, SGBD or any other Saint-Gobain group company, or the immediate families of such employees, or public sector or housing association employees;

 

 

1.4.4

any and all employees of any agencies or event suppliers or their families or agents or any other person officially connected with the Rewards Programme; and

 

 

1.4.5

any customers that currently receive, or are connected to a customer that currently receives, a rebate from Jewson, any other brands of Jewson Limited or SGBD.

 

 

If there is any uncertainty as to who may be a Participant and who may take part in this Rewards Programme, please contact the Jewson Marketing Department on 02476 438400 or at info@juicerewards.co.uk whose decision shall be final and binding.

 

1.5

The Rewards Programme shall only apply to products purchased from Jewson and/or Jewson Limited trading as George Boyd ("George Boyd") by the Participants.

 

1.6

In order to participate in the Rewards Programme, Participants must first register for the Rewards Programme. Registration can be done by either:

 

 

1.6.1

Activating and registering your plastic Juice by Jewson card by completing the online registration form on the Website;

 

 

1.6.2

completing the online registration form on the Website and requesting a card to be provided.

 

 

When completing the registration form all Participants must provide a valid email address that is registered to the Participant (for the avoidance of doubt, no Saint-Gobain email address may be used for this purpose), together with their Account number and the postcode for where invoices on such Account are sent. The Website will then validate the information that has been provided. Jewson may require a new online registration form to be completed for each Membership Year (as defined below). Participants will not be able to redeem any Points (as defined below) until they have completed the online registration form in full. An activation email for the Participant’s Juice by Jewson account (the “Juice by Jewson Account”) will be sent to each Participant once registration for the Rewards Programme has been successfully completed. The Participant will then need to choose a password to access their Juice by Jewson Account. Unless Jewson expressly determines otherwise, only one set of log-in details will be provided per Participant. Participants will be automatically enrolled for new editions of the Rewards Programme if they are still participating in the Rewards Programme at the end of the expiring Membership Year (as defined below).

 

1.7

No third party or joint registrations will be accepted and only one registration per Participant will be accepted. Connected companies shall be deemed to be the same as the Participant to which they are connected, and deemed duplicate accounts dealt with accordingly. If a Participant has more than one Account that is in the same name and registered to the same postal address, each Account may be added to the Participant’s Juice by Jewson Account by following the instructions on the Website.

 

1.8

Jewson reserves the right to refuse, merge or close additional Juice by Jewson Accounts at any time.

 

1.9

Unless Jewson expressly agrees otherwise in writing, the primary methods of communication in connection with the Rewards Programme shall be via the Website, emails and/or text messages (depending on the contact information supplied at registration).

Participants

 

2.1

If the Participant is acting as an individual or a partnership, the Participant must be resident in the UK and remain resident throughout the twelve month period commencing from the first day of the month during which the Participant’s register for the Rewards Programme (the “Rewards Programme Joining Date”) and for each following twelve month period commencing on each anniversary of the Rewards Programme Joining Date (each 12 month period shall be termed a “Membership Year”) and be aged 18 or over at the date of the Rewards Programme Joining Date.

 

2.2

If the Participant is a limited company or another entity with separate legal identity the Representative of that Participant must:

 

 

2.2.1

be aged 18 or over; 

 

 

2.2.2

confirm, by completing the online registration form on the Website, that he or she:

 

 

 

i.

has the authority to bind the Participant on whose behalf the Representative completes the online registration (i.e. the Account holder); and

 

 

 

ii.

has made the Participant aware of the Rewards Programme and has its consent to enter into the Rewards Programme on its behalf.

 

2.3

It is a condition of entry that all information given at registration is true, current and full. It is the Participant’s obligation to update (or ensure that the Representative updates) any information submitted upon registration and to ensure that the Participant’s details (including its customer account details) remain accurate and up to date. Unless Jewson expressly agrees otherwise in writing, all Rewards (as defined below) and communications that need to be sent to the Participant will be sent to the address held in Jewson’s central customer account database. Jewson will not be liable for any breach of these Terms and Conditions arising from the Participant’s failure to update the information submitted or for any lost, delayed or undeliverable communications. If the Participant (or its Representative) does contact Jewson (or its agents) to update any details the Participant (or its Representative) may be required to go in to their Jewson branch to make changes to their customer account details, unless changes can be made remotely by Jewson, in which case they will be asked certain security questions before amendments to the Participant’s Rewards Programme account (the “Juice by Jewson Account”) or the Participant’s Account are made.

 

2.4

If the Participant (or its Representative) fails to provide all of the requested and required information (including any security information), the Participant may be disqualified and not permitted to participate in the Rewards Programme.

 

2.5

Jewson is not responsible for incomplete, unclear, incomprehensible or distorted entries to the Rewards Programme. Such entries will be void.

 

2.6

It is the Participant’s responsibility to keep secure any information that might identify the Participant and/or its Representative and allow access to the Participant’s Juice by Jewson Account. Neither Jewson nor its agents shall be responsible or liable in any way if a person is able to redeem or spend any Points (as defined below) as a result of the Participant and/or the Representative not taking proper care of the Participant’s Juice by Jewson Account details. If the Participant and/or the Representative loses or accidentally reveals its log-in details it is their responsibility to change their password via the Website. If they are unable to do this they should immediately contact the Rewards Programme Administrator by email info@juicerewards.co.uk or by telephone on 01509 410730.

3

Collecting Points and Rewards

 

3.1

3.1. Jewson shall award Participants with 1 electronic reward point (each a “Point” together the “Points”) per £1 (one GBP) of Qualifying Spend.

 

3.2

Qualifying Spend” shall include:

 

 

Any spend by a Participant on orders through any Account that has been registered by the Participant to their Juice by Jewson Account that are either collected from a branch branded Jewson or George Boyd within Jewson’s or George Boyd’s network of branches (a “Branch”) or delivered by Jewson or George Boyd; and any spend by a Participant on tool hire from Jewson.

 

 

3.2.1

But shall not include:

 

 

 

i.

Any spend by a Participant on orders that are delivered direct to site by Jewson’s third party supplier.

 

 

 

ii.

Any carriage charges;

 

 

 

iii.

Any value added or other sales tax;

 

 

3.2.2

Spend on certain products may be excluded from the Rewards Programme at the discretion of Jewson and/or George Boyd (where appropriate).

 

 

Qualifying Spend only includes actual spend with Jewson and/or George Boyd and any discounts or other offers that the Participant benefits from will not count towards the calculation of such Qualifying Spend.

 

3.3

If a Participant requires a refund on any spend made which was included within the Qualifying Spend (even after the expiry of the relevant Membership Year), Jewson and/or George Boyd will deduct the value of the refund from the Qualifying Spend (the “Deducted Qualifying Spend”) and any Points that were awarded in relation to that Deducted Qualifying Spend shall be deducted from the Participant’s Point total in their Juice by Jewson Account (the “Deducted Points”).

 

3.4

If a Participant submits a Redemption (as defined in clause 4.2 below) and prior to the Participant receiving the Reward any Deducted Points takes the Participant’s Points total within its Juice by Jewson Account to a negative figure, Jewson reserves the right to cancel the Reward which the Participant submitted the Redemption for. The Points that the Participant had submitted the Redemption for will then be returned to its Juice by Jewson Account which the Participant may go onto submit a further Redemption for in due course.

 

3.5

Jewson reserves the right to discount or ignore any spend by a Participant when calculating the Qualifying Spend in the event that it has reason to believe that such spend is not genuine. Jewson’s decision as to which spend by a Participant will and will not count towards the Qualifying Spend shall be binding on the Participant and final.

 

3.6

The Participant may collect the Points and utilise them to purchase experiences, benefits, selected products, vouchers and/or Partner Deals (“Rewards”) in connection with the Rewards Programme.

 

3.7

Points will only be awarded in relation to Qualifying Spend from the Rewards Programme Joining Date. No other backdating of Points allocation will be permitted.

 

3.8

If by midnight on the last day of the month immediately following the end of a Membership Year, a Participant has any Points which it has not submitted a Redemption (as defined in clause 4.2 below) for (“Remaining Points”), twenty five percent (25%) of the Remaining Points will be forfeited and the Participant will not be entitled to any compensation or damages from Jewson and/or its agents in connection with those forfeited Points.

 

3.9

Jewson (and/or its agents) will maintain a Juice by Jewson Account that records all Qualifying Spend for the relevant Membership Year and the corresponding Points that have accrued in connection with that Qualifying Spend. Points will be updated in the Juice by Jewson Account on a regular basis.

 

3.10

Jewson (or its agents) may send the Participant and/or the Representative (if any) details of the current levels of the Qualifying Spend and/or the current number of accrued Points and the Participant and the Representative will be able to view the most recently updated figures for the Qualifying Spend and the Points in the Participant’s Juice by Jewson Account by logging into the Website with the Participant’s log-in details.

 

3.11

Jewson and its agents reserve the right to correct any mistakes that are made in respect of the Qualifying Spend and/or the number of Points issued to the Participant but recommends that the Participant keeps records of its transactions so that it (or the Representative) can check that the information held is accurate. Any queries in connection with the number of Points accrued should be presented in writing to Juice by Jewson at the address set out at the end of these Terms and Conditions.

 

3.12

Rewards will be advertised on the Website and, subject to availability, may be ordered at any time while they appear on the Website, provided that the Participant has accrued sufficient Points. Redeemed Points cannot be used again and the Participant’s Juice by Jewson Account balance will be reduced to reflect the number of redeemed Points.

 

3.13

Points cannot be redeemed until credited to a Juice by Jewson Account. In the event that a credit note or refund is issued to a Participant, or the Participant fails to pay in accordance with their agreed payment terms for any goods purchased from Jewson or any other brand of Jewson Limited or SGBD (as appropriate), Jewson shall be entitled to subsequently reduce the number of Points accrued to the Participant’s Juice by Jewson Account or (if already redeemed) clawback the value of the relevant Points from future accruals of Points.

 

3.14

The Participant is the holder of its Points and is responsible for their security. Jewson are the overall owners of all Points and they remain its property at all times, until redeemed by the Participant as the Juice by Jewson Account holder.

 

3.15

Participants are not eligible for any cash equivalent in return for their Points or in lieu of receiving a particular Reward.

 

3.16

The Participant cannot transfer, sell or use its Points for any purpose except as permitted under these Terms and Conditions. If the Participant attempts to transfer Points in any way that is not permitted by these Terms and Conditions Jewson reserves the right to take such action against the Participant as it considers appropriate.

 

3.17

Dates on which the Rewards will take place will be available on the Website or otherwise confirmed by the relevant agent and/or Rewards Programme Partner (as defined below).

 

3.18

Jewson reserves the right to modify scheduling of any Rewards or the Rewards Programme without prior notice at any time and for any reason.

 

3.19

Jewson further reserves its right to substitute any Reward with a Reward/reward of equivalent value in the event of circumstances outside of its control.

4

Claiming a Reward

 

4.1

4.1. Points can be redeemed against Rewards advertised and available on the Website. Points cannot be redeemed against an Account.

 

4.2

If a Participant wishes to redeem its Points it must submit an on-line redemption form via the Website for any Rewards that it wishes to claim (a “Redemption”). At the point in time that the Redemption is submitted, the Participant must have sufficient Points within its Juice by Jewson Account for the Reward being claimed.

 

4.3

Certain Rewards are subject to limited availability and will be allocated on a strictly ‘first come, first served’ basis. Where a particular Reward is dependent on a minimum volume of orders being placed the Participant acknowledges and understand that such Reward may be withdrawn or cancelled by Jewson (in its absolute discretion) and will only be provided if a sufficient number of customers sign up for that Reward.

 

4.4

The number of Points payable for each Reward is shown on the Website and may be amended at any time prior to the Participant submitting a Redemption for a particular Reward.

 

4.5

Despite the efforts of Jewson and/or its agents, some Rewards advertised on the Website may have been attributed with an incorrect value (i.e. the number of Points payable for that Reward). If this is the case Jewson will contact the Participant or the Representative (if any) and determine how best to proceed. For the avoidance of doubt, there will be no obligation on Jewson to provide Rewards for the number of Points advertised where such an error has been made, whether by Jewson, an agent or any other third party.

 

4.6

The Participant acknowledges that transactions on which Points are redeemed may be made directly with third party merchants and/or suppliers (the “Rewards Programme Partners”, each a “Rewards Programme Partner”) who may offer links to their websites via the Website (“Third Party Sites”).

 

4.7

Jewson is not responsible for Third Party Sites nor for any product information or services supplied through or in connection with such Third Party Sites.

 

4.8

Jewson has no responsibility for the standard, quality or otherwise of any Rewards, goods or services received or supplied by a Rewards Programme Partner or the failure of any Rewards Programme Partner to honour a redemption.

 

4.9

Any dealings that the Participant, the Representative or the Nominee(s) (as defined below) may enter into with any Rewards Programme Partner (or other third party) will be solely between them and that Rewards Programme Partner (or other third party), including any transaction for the purchase of products from such Rewards Programme Partners (or other third parties). All such dealings will be subject to these Terms and Conditions and privacy policies of such Rewards Programme Partners (or other third parties) as are applicable to such transactions.

 

4.10

No change to a Reward can be made by the Participant after it has been booked in accordance with the information submitted on the on-line redemption form.

 

4.11

If the Participant wishes to amend their Reward in any way, such as extending their stay or adding additional travellers the Participant must state this when claiming their Reward. Jewson and their agents will endeavour to provide suitable arrangements and will require the Participant to pay any additional costs before such arrangements can be made.

 

4.12

The Reward cannot be transferred, exchanged, sold or in any way traded. The Reward cannot be used for third party entertainment or gifted or awarded to a third party who is not within the employ of the Account holder.

 

4.13

For the avoidance of doubt, Rewards earned by a business holding an Account shall be for the benefit of the named account holder and not any other individual. It is for the named account holder (i.e. the Participant) to nominate the person or persons who is/are to receive the Reward (“Nominee(s)”) at the time the on-line redemption form is submitted. The Nominee must be an employee of the Account holder.

 

4.14

Any Rewards that individuals from the Participant’s business receive are received purely in the capacity of an agent, acting on behalf of the Participant. It will be the responsibility of the Participant to determine who has access to the Rewards Programme on its behalf and any decision entitling individuals to be the recipient of Rewards rests with the Participant and not with Jewson.

 

4.15

Rewards shall only be permitted to go ahead if: (i) on the date of applying for the Reward the Participant has no outstanding invoices attributable to the Membership Year; and (ii) their Account has not been suspended by Jewson due to non-payment/legal issues.

 

4.16

The Participant agrees to make an individual participating in or receiving a Reward on its behalf aware of these Terms and Conditions.

 

4.17

All persons attending, participating in or receiving a Reward may be required to enter into a waiver of responsibility and by attending, participating in or receiving a Reward, such individuals agree to be bound by these Terms and Conditions and the terms and conditions of the relevant Rewards Programme Partner.

 

4.18

If a transaction on which Points are redeemed is cancelled, reversed or not completed then, where appropriate, Jewson will reverse the associated Points movement when instructed by the relevant Rewards Programme Partner.

5

Taxes

 

5.1

The Participant acknowledges and agrees that accepting a Reward may be subject to tax and/or National Insurance. The Participant shall be fully responsible for and shall indemnify Jewson for and in respect of any VAT, corporation tax, income tax, National Insurance and social security contributions and any other liability, deduction, contribution, assessment or claim arising from or made in connection with receipt by the Participant or any individual selected by it of a Reward. For further information the Participant should contact its nearest Inland Revenue Office.

Membership Level and Associated Benefits

 

6.1

6.1. Each Participant will be awarded a membership level of the Rewards Programme that is consistent with their Points that it has accrued (the “Membership Level”) as follows:

6.2

Upon registration by a Participant for the Rewards Programme, a Participant will be awarded a blue Membership of Juice by Jewson.

 

6.3

6.3. Each Participant will receive benefits associated to its membership level (and any lower membership level) which will be notified by Jewson from time to time and which may be subject to amendment or withdrawal by Jewson at any time without prior notice (the “Benefits”).

 

6.4

The Benefits are for the benefit of the Account holder.

 

6.5

A Participant will change its membership level immediately upon gaining the Points level required to go into the next Membership Level and consequently be entitled to the Benefits linked to that new Membership Level. Once in a Membership Level in any Membership Year, the Participant will not drop to a lower Membership Level during that Membership Year even if the Participant spends a number of its Points which takes its Points total below that required for that particular Membership Level. In the following Membership Year (“Membership Year +1”), a Participant will again not drop a Membership Level (but may progress to the next Membership Level if sufficient Points are acquired), but in the event that the Participant does not accrue Points that match that particular Membership Level in the Membership Year +1, their Membership Level will be reduced at the end of Membership Year +1 to the appropriate Membership Level to match their Point accrual in the Membership Year +1.

7

Liability

 

7.1

Subject to clause 7.2:

 

 

7.1.1

Jewson shall under no circumstances whatsoever be liable to the Participant (or any individuals selected by the Participant to receive a Reward), whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any acts or failures of any Rewards Programme Partner or other third party or for any loss of profit, or any indirect or consequential loss arising under or in connection with the Rewards Programme or the participation in the Rewards Programme of any Participant or any individual selected by the Participant to receive a Reward; and

 

 

7.1.2

Jewson accepts no responsibility for any loss or damage caused by the negligence of Jewson, its servants or agents out of or in connection with this Rewards Programme except where caused by wilful neglect of Jewson, its employees or agents.

 

7.2

Nothing in these Terms and Conditions excludes or limits Jewson’s liability for:

 

 

7.2.1

death or personal injury resulting from the negligence of Jewson, its employees or agents; 

 

 

7.2.2

fraud or fraudulent misrepresentation; or

 

 

7.2.3

any matter in respect of which it would be unlawful for Jewson to exclude or restrict liability.

 

7.3

The Participant hereby agrees to release and to hold Jewson (and its employees, officers, directors, agents, marketing partners and affiliates) harmless from any and all losses, damages, rights, claims and actions of any kind in connection with or arising from:

 

 

7.3.1

any breach of these Terms and Conditions by the Participant or any person it selects to receive the Reward; and

 

 

7.3.2

the:

 

 

 

i.

delivery of any Reward;

 

 

 

ii.

acceptance of any Reward;

 

 

 

iii.

use of any Reward; and/or

 

 

 

iv.

misuse of any Reward.

 

7.4

Jewson recommends that the Participant obtains suitable insurance in respect of the attendance, participation or receipt of a Reward by the Participant or any individual selected by it. Obtaining any such insurance is at the Participants discretion and is for its own account. Jewson shall not be responsible for any such insurance.

 

7.5

Jewson will not accept liability for changes to the venues or events due to decisions by the Rewards Programme Partner of any Reward. Jewson reserves the right to change the venue and/or dates for a Reward and/or the actual Reward at any point and will provide an alternative venue, date and/or Rewards of equal value. Jewson accepts no responsibility for any loss incurred as a result of these changes.

 

7.6

No cash alternative or equivalent shall be provided for the Rewards.

 

7.7

Jewson undertakes to use reasonable efforts to ensure that its agents and its Rewards Programme Partners maintain adequate email, internet and other communication links but is not otherwise responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible registrations; (ii) telephone, electronic, hardware, or software program, network, internet, or computer malfunctions, failures, delays or difficulties; (iii) errors in transmission; or (iv) deliveries of Rewards attempted but not received. If the Participant is disqualified, Jewson, its agents and its Rewards Programme Partners shall be under no obligation to publish this fact on the Website or anywhere else.

8

Termination

 

8.1

Jewson reserves the right to amend, suspend or withdraw this Rewards Programme, any Reward or any Benefit in whole or in part at any time without prior notice or compensation and the Participant’s right to use any accumulated Points will be forfeited and the Participant will not be entitled to any compensation or damages from Jewson, its agents or any third party.

 

8.2

Jewson may terminate the Participant’s participation in the Rewards Programme and cancel or suspend any Points in the Participant’s Juice by Jewson Account by notifying the Participant and/or the Representative (if any) in writing if Jewson reasonably believes that the Participant and/or the Representative

 

 

8.2.1

has acted in a way that harms Jewson, any Saint-Gobain group company, any of its agents, the Rewards Programme or any Rewards Programme Partner;

 

 

8.2.2

engaged in any illegal or fraudulent activities;

 

 

8.2.3

has collected or redeemed Points dishonestly or in a way that breaks these Terms and Conditions

 

 

8.2.4

has acted in a hostile, abusive or aggressive manner towards any of Jewson’s staff, any of its agents’ staff or any of its Rewards Programme Partner’s staff;

 

 

8.2.5

has knowingly provided false or misleading information at any time in relation to the Participant’s participation in the Rewards Programme;

 

 

8.2.6

has breached or attempted to breach any of the terms relating to the Participant’s Account or Juice by Jewson Account (including, but not by way of limitation, failing to pay its Account in accordance with the applicable payment terms);

 

 

8.2.7

has had a zero balance on its Juice by Jewson Account for a consecutive 6 month period;

 

 

8.2.8

8.2.8. has not made any purchases through an Account for a consecutive 12 month period.

 

8.3

In the event that the Participant’s Juice by Jewson Account is withdrawn from the Rewards Programme or is terminated at Jewson’s discretion the Participant’s right to use any accumulated Points will be forfeited and the Participant will not be entitled to any compensation or damages from Jewson, its agents or any third party.

 

8.4

The Participant or the Representative can choose to withdraw the Participant’s participation in the Rewards Programme at any time by contacting the Rewards Programme Administrator by email or by telephone at the address/number referred to in clause 2.6 above. Any accumulated Points not claimed by the date of withdrawal shall be forfeited and the Participant will not be entitled to any compensation or damages from Jewson and/or its agents.

Competitions

 

9.1

From time to time Jewson may run a competition for Participants in the Rewards Programme. When this occurs, a list of the successful Participants, by first name and County, will be available from Juice by Jewson, Saint-Gobain House, Binley Business Park, Coventry CV3 2TT.

10

Data Protection and Publicity

 

10.1

By participating in the Rewards Programme, the Participant, and any Nominee(s) or other individual who accepts or agrees to receive any Reward at the direction of the Participant, consent to:

 

 

10.1.1

Jewson processing the Participant’s and any such individual’s data; and

 

 

10.1.2

the Participant’s and any such Nominee’s or individual’s name, details and/or photographs appearing in publicity material or other events relating to the Rewards Programme.

 

10.2

The Participant may be asked to participate in future publicity or PR activities, which may involve taking photographs. The Participant shall use it best endeavours to participate in such activities and procure that any Nominees or individuals selected by it to receive any Reward participate in such activities.

 

10.3

The Participant understands and accepts that as a participant in the Rewards Programme they will be sent regular updates by Jewson on the status of their Juice by Jewson Account, including their level of Qualifying Spend and the number of Points accrued to date (“Account Updates”). Any details of Qualifying Spend spent at George Boyd will be shared with Jewson to the extent necessary for the purposes of the Rewards Programme. Account Updates may also include information about Rewards that could be available to the Participant. Agreeing to receive Account Updates is a condition of taking part in the Rewards Programme.

 

10.4

In addition to the Account Updates referred to above, the Participant agrees that Jewson and/or its agents may use any information relating to the Participant provided by the Participant and/or the Representative (if any) in connection with the Rewards Programme, or generated by Jewson and/or its agents in connection with the Rewards Programme, to market Jewson’s products to the Participant. Marketing information may be issued in various formats, including (but not be limited to) letters, emails and/or text messages.

 

10.5

Jewson’s Privacy Policy sets out the information that Jewson will gather on Participants, Representatives and Nominees, how a Participant earns and redeems Points, how this information will be used and who it may be shared with. Every Participant and Representative (if any) should carefully read the latest version of the Privacy Policy. If a Participant notifies Jewson that they do not wish to receive marketing information referred to in clause 10.4 above from Jewson, its agents and/or its Rewards Programme Partners or be contacted by Jewson, its agents and/or its Rewards Programme Partners for Rewards Programme purposes, Jewson will comply with such request and pass on any relevant request to the relevant agents and/or Rewards Programme Partners.

Additional terms and conditions

 

11.1

The Rewards are supplied by Rewards Programme Partners and the receipt of a Reward by the Participant (or any individual selected by it) will be subject to such Rewards Programme Partner’s terms and conditions, which should be read carefully.

 

11.2

In addition to, or in conjunction with, these Terms and Conditions and the applicable the terms and conditions of any Rewards Programme Partners, the terms of Schedule 1 of these Terms and Conditions will apply to specific relevant Rewards.

12

General Conditions

 

12.1

These Terms and Conditions replace all previous versions and are correct as at the date published below. Jewson reserves the right to amend these Terms and Conditions, the Website Terms of Use, the Privacy Policy, the Acceptable Use Policy and/or the Cookie Policy at any time. Participants who continue to participate in the Rewards Programme following any such amendments will be considered to have accepted such updated documents.

 

12.2

Any advice or actions of Jewson’s staff, the staff of any of the agents or the staff of any Rewards Programme Partners engaged in connection with the Rewards Programme, that is contrary to these Terms and Conditions will not have the effect of amending these Terms and Conditions.

 

12.3

Jewson (and its employees, officers, directors, agents, marketing partners and affiliates) shall not be in breach of these Terms and Conditions or be liable for any disruption to the Rewards Programme, a Reward or a Benefit, or any delay in performing or failure to perform, any of its obligations under these Terms and Conditions if such disruption, delay or failure results from events beyond the reasonable control of Jewson.

 

12.4

Jewson reserves the right to vary these Terms and Conditions or cancel the Rewards Programme at any stage in the event of circumstances arising beyond its reasonable control.

 

12.5

The Rewards Programme is a stand-alone Rewards Programme and does not amend normal terms and conditions of trading as between Jewson and its customers, which will continue to apply.

 

12.6

No failure or delay by Jewson to exercise any right or remedy provided under these Terms and Conditions or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

 

12.7

No one other than Jewson and the Participant, their successors and permitted assignees, shall have any right to enforce any of these Terms and Conditions.

 

12.8

Nothing in these Terms and Conditions is intended to, or shall be deemed to, establish any partnership between Jewson and any of the Rewards Programme Partners.

 

12.9

These Terms and Conditions, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with, English law, and the English courts shall have exclusive jurisdiction over any proceedings in connection with these Terms and Conditions and the Jewson Rewards Programme.

 

12.10

The Participant’s statutory rights are not affected by any of the above Terms and Conditions.

 

12.11

Any correspondence regarding the Rewards Programme should be addressed to the Rewards Programme Administrator at: Juice by Jewson, Jewson, Saint-Gobain House, Binley, Coventry CV3 2TT.

Schedule 1 – Additional Terms

 

1.

Rewards involving overseas travel will require each traveller to have a valid passport.

 

2.

When the Reward involves air travel the individuals due to receive the Reward will be responsible for any costs accrued for airport parking and any other ancillary expenses.

 

3.

If the Reward includes a trip or a holiday, it is the responsibility of the main traveller to ensure that s/he and his/her family or travel companions who are accompanying them on the trip all have the necessary travel insurance, any recommended inoculations or other medical precautions and visas/passports. Jewson or any suppliers linked with the Rewards Programme will not be held responsible for any travellers having inadequate travel insurance or being unable to travel through not having the necessary passport or visa.

 

4.

All Rewards are offered subject to availability and restrictions may be imposed as to when each Reward may be taken. Travel must take place within 6 months of the date on which the Participant claims the Reward. Travel is excluded during all UK bank or public holiday periods and further date exclusions may apply, as shown within the description of each Reward on the Website. Excluded dates may be amended at any time prior to the Participant claiming the Reward, without prior notice.

 

5.

Once a Reward has been claimed by a Participant, no cancellations, refunds or other amendments will be possible. However, for certain sporting fixtures or other events that are taking place on a specific date, Jewson may be able to accept cancellations and a reallocation of relevant Points if at least 4 weeks prior notice is provided.

 

6.

Jewson cannot be held responsible for any travel or banning restrictions imposed by the UK police, borders agency or courts in relation to any individuals due to receive the Reward.

 

7.

Those participating in motor-based Rewards (cars/bikes, on/off road, official track) must hold a current full and valid UK driving licence.

 

8.

Expenses incurred during or as a result of participation in any of the Rewards which are not specifically stated to be included in the Reward are not included in the Reward and shall be for the Participant’s own account. For example:

 

 

8.1.

Unless otherwise stated, Participants will be responsible for arranging and providing their own means of transportation to and from a Reward.

 

 

8.2.

Transfers to and from UK mainland airports or the venue where a Reward is to take place are not included in the Reward itself. For the avoidance of doubt, Participants located outside the UK mainland are responsible for their own transfer to the UK mainland or the venue where a Reward is to take place. Economy class flights from a mainland UK airport are included in a Reward only where stipulated.

 

 

8.3.

In the event of any dispute, the decision of Jewson and its appointed representatives is final in all matters and no correspondence shall be entered into.

 

9.

Where a reward is being delivered to you by post or by courier this will normally take 21 days at most from the date of your claim and we will contact you in the unlikely event of a delay beyond that. If you have not received your reward within 21 days of your claim please notify us immediately by email or by phone as we may be unable to trace any items reported more than 28 days after your claim. Please also open and check your package immediately on delivery as any missing or damaged items must be notified to us within 48 hours of delivery if any claim for replacement is to be considered.
